IATE central EU terminology project

I’m recording this for my own interest. Last November, a message on the Usenet group sci.lang.translation mentioned the test version of a projected centralized terminology database for the EU, called IATE or Inter-Agency Terminology Exchange. Here is more information.

At that time it was said that IATE would probably be going live in March, at which time the database would be moved elsewhere before going live. But it seems not to have moved yet.

To access the database, go to this site, and use the Username w0300005 and Password w03005.

I had a quick look at Vertragsstrafe, and it wasn’t particularly helpful. There’s a general recommendation to translate this into English as liquidated damages see earlier entry) – also being discussed on ProZ at present.

  1. Bei ProZ wird vielleicht auch durch den Verweis auf den Traficanti-Fall etwas durcheinander gebracht. Traficanti spricht von Civil Penalties. Diese haben mit Liquidated Damages und Vertragsstrafe nichts gemein, denn Civil Penalties stehen den deutschen Strafen fuer Ordnungswidrigkeiten nahe: keine strafrechtliche Bestrafung, aber doch eine Sanktion fuer Fehlverhalten. Insgesamt gehoert dies jedoch nicht in den zivilvertragsrechtlichen Bereich der Vertragsstrafe. Das strafrechtliche und ordnungswidrigkeitenrechtliche Konzept darf man nicht mit dem zivilrechtlichen Konzept vermischen.
    Selbst wenn im amerikanischen Recht von Civil Penalty gesprochen wird, handelt es sich um eine Massnahme nichtvertragsrechtlicher Art, sondern einen hoheitlichen Eingriff, der nach deutschem Recht in den Bereich des Straf- und vielleicht des Verwaltungsrechts faellt.
    Margaret, von den verschiedenen bei ProZ angebotenen Alternativen erscheint mir Ihrer der richtige.

  2. Thanks, Clemens. Actually, I was just backing up Fred Thomson and Anne Gillard-Grodeck, who both said ‘liquidated damages’. The normal choice is ‘liquidated damages’ or ‘contractual penalty’. I didn’t see a reference to Traficanti of civil penalties. But Ihadn’t given any thought to that at all.

  5. Jez might be able to read Counsel on French questions, but not me – I only comment on German, and sometimes English-English, but Jez doesn’t do German – he’s another translator blogger erstwhile in Paris.
