This is an interesting turn of events. I wonder how many native German judges can tell the difference between a US-type anti-trust agreement vs. an English trust for sale, a set-off vs. compensation or a restrictive covenant vs. a no-compete agreement/restraint of trade. The only one I know who can is an English-qualified Barrister who went on to sit as an Appeal Court Judge in London.
Really interesting article. Translation is always tricky.
